Like Jonah Goldberg, I'm officially off the fence and against Miers....
Her support of race and sex set-asides can only be the views of someone who feels the Constitution allows race and sex-based distinctions.... and if she feels that way, then I don't care how good a bowler she is, there is no way she belongs on the Supreme Court. In fact, those views should disqualify her from even serving as Bush's counsel*. If she thought the Constitution forbids sex and race based distinctions, then there is no way she should be backing such programs. If something is wrong, it is wrong... regardless of whether the Supreme Court says it is okay. It's the position she takes with regards to abortion: she feels abortion is wrong and it doesn't matter to her - as it shouldn't - that the Supreme Court allows the practice. The fact that she favors set asides demonstrates she sees nothing wrong with the practice... either Constitutionally or morally. * and for those debating the extent to which Bush is or isn't a true conservative, let me ask you: how many true-blue conservatives hire have pro-affirmative action types as one of their most trusted confidants? |
