Not one to shy away from calling them like he sees them, Beldar calls Dahlia Lithwick a liar for her mispresenting Roberts opinion in the DC Metro french fry case, specifically, for her claim that Roberts "seemingly finds arresting them for French-fry possession to be a cornerstone in good parent-child relations". And like Beldar, I'm not holding my breath waiting for Lithwick to substantiate her claim...
For anyone unfamiliar with the particulars a young girl was caught eating a french fry on a DC Metro railcar. DC Metro, from day one, has had a strict no eating, no drinking policy and they have arrested/issued summons to a number of people for violating the policy. In this case, policy was to hold the young girl until she was picked up by her parents. John Rutherford, head of a conservative/libertarian (I'm not always sure which one) interest group financed the appeal where the Appeals Court not only affirmed that Metro could have such a policy but that there were no issues associated with the way she was treated on account of her age.... but the important thing to know is that the appeals court, while affirming the right Metro's right to do what they did, made no secret of their belief that it was a really stupid thing to do.... it just wasn't unconstitutional for them to do so. |
